These terms and conditions apply to your use of the Art News website and to purchases made through our online store. By using this website or placing an order with us, you agree to these terms. Nothing in these terms limits any rights you may have under the Consumer Guarantees Act 1993, Fair Trading Act 1986 or any other rights that cannot lawfully be excluded.

Orders & Payment

All prices are shown in New Zealand dollars and include GST where applicable, unless otherwise stated. Payment must be made using one of the payment methods available at checkout. Your order is subject to availability and confirmation of payment.

We take care to ensure that product descriptions, prices and other information on the website are accurate. If we discover an error affecting an order, we will contact you as soon as reasonably possible. If an item becomes unavailable after you place an order, we will contact you and arrange an appropriate refund or alternative.

Availability

Our printed issues are produced in limited quantities and may sell out. We do not guarantee that a particular issue or product will remain available. Availability shown on the website may change without notice.

Postage & Delivery

Orders are dispatched from Aotearoa New Zealand. Delivery costs and available delivery destinations are shown at checkout. Further information about dispatch, delivery, tracking and international orders can be found on our Postage page. We aim to dispatch orders promptly, but delivery times are estimates rather than guaranteed dates unless expressly stated otherwise. Under New Zealand consumer law, businesses remain responsible for ensuring goods are delivered within the agreed timeframe or, where no timeframe has been agreed, within a reasonable time.

International Orders

Customers placing orders for delivery outside Aotearoa New Zealand are responsible for any customs duties, import taxes, fees or other charges imposed by the destination country. These charges are not included in the price of your order or postage.

Subscriptions

Art News is published four times a year. When purchasing a subscription, the number of issues, price and any applicable renewal arrangements will be displayed. Subscribers are responsible for providing an accurate delivery address and letting us know of any address change before the next issue is dispatched.

If an issue has already been dispatched to an address previously supplied by you, we may not be able to provide a replacement free of charge.

Returns, Refunds & Change of Mind

We are not required to provide a refund or exchange because of a change of mind. This does not affect your rights under the Consumer Guarantees Act 1993.

Damaged or Missing Orders

If your order arrives damaged, please email info@artnews.co.nz with your order number and photographs of the damage. For an item that appears to have been lost in transit, please contact us with your order number so we can investigate the delivery. We will assess each situation and provide a remedy where required under applicable consumer law.

Website Information

We make efforts to keep information on this website accurate and current. Colours, photographs and other visual representations of printed products may appear slightly different depending on your screen or device. We may update, correct or remove website content where necessary.

Intellectual Property

The design, branding, writing and other original content appearing on the Art News website is owned by or licensed to Art News. The website may also contain artworks, photographs, writing and other material owned by third parties and reproduced with permission or under applicable licence terms.

Content may not be reproduced, republished, distributed or commercially exploited without the permission of the relevant rights holder, except where permitted by law.

Third-Party Links

Our website may contain links to websites operated by other organisations. These links are provided for information or convenience. Art News is not responsible for the content, availability, privacy practices or operation of third-party websites.

Subscription Prize Draws

From time to time, Art News may run promotional prize draws in connection with subscriptions to the magazine. The specific terms of each prize draw will state the eligibility requirements, opening and closing dates, prize and its retail value, method of entry, draw date, method of selecting the winner and how the winner will be contacted.

Where entry is linked to the purchase of an Art News subscription, no additional entry fee will be charged beyond the usual subscription price, and the subscription price will not be increased for the purpose of entering the promotion. Where a promotion is entered through an online purchase and the winner is determined by chance, the winner will be selected by random draw after the entry period has closed.

Unless otherwise stated in the specific promotion: Entrants must be residents of Aotearoa New Zealand aged 18 years or over. Entries must be received within the stated promotion period. Prizes are not transferable, exchangeable or redeemable for cash. Any costs not expressly included in the prize are the responsibility of the winner. If a winner cannot be contacted within the period stated in the promotion, or is found to be ineligible, another winner may be drawn. Employees of Art News and people directly involved in administering the promotion are not eligible to enter. Where a promotion is conducted with another organisation, any additional terms stated for that promotion will also apply.

All material conditions will be published before the promotion begins and will not be changed after the promotion has started. Where a promotion is conducted through a third-party platform, entrants must also comply with any applicable rules of that platform.

Privacy

Our collection and use of personal information is explained in our Privacy statement. By providing information to us through the website, you acknowledge that it will be handled in accordance with that statement and applicable New Zealand privacy law.

Our Liability

Nothing in these terms excludes or limits any liability or consumer right that cannot lawfully be excluded or limited.

Changes to These Terms

We may update these Terms & Conditions from time to time to reflect changes to our website, products, services or legal obligations. The current version will be published on this page. Changes apply from the date the updated terms are published and do not retrospectively alter an order already accepted by us unless required by law or agreed with you.

Governing Law

These Terms & Conditions are governed by the laws of New Zealand.
